("Contest")

OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. TO ENTER: Between 08/19/07 and 11/19/07, record or write how Hungry Jack products are always a crowd pleaser for your family in any of the following ways: 1) Audio – record your entry in English in 25 seconds or less on an audio cassette tape or CD (or digitally in one of the formats listed below); 2) Video - record your entry in English in 25 seconds or less on a VHS video tape or DVD/CD; or 3) Written - hand-print or type an original essay of 50 words or less on a piece of 8 1/2” x 11” paper in English. You may submit your entry one of two ways: 1) By Mail - send your entry along with your name, complete address, daytime phone number, e-mail address (if applicable) and date of birth on the back of your entry or secured to your video or audio entry in an envelope with proper postage affixed to: Hungry Jack Crowd Pleaser Contest, P.O. Box 8528, Prospect Hts., IL 60070. Entries must be postmarked by 11/19/07 and received by 11/26/07. Enter as often as you wish, but each entry must be substantially different and mailed in a separately postmarked outer mailing envelope. 2) By Internet – starting at 12:00 AM ET on 08/19/07, go to www.hungryjack.com and follow the on-screen directions to submit your entry. Audio entries must be submitted in one of the following formats only: .mp3, .wav, .wma, .aif, .aac, .ram (10-25 sec. 2mb max). Video entries must be submitted in one of the following formats only: .wmv, .mov, .mpg, .mpeg, .mp4, .m4v, .qt, .rm (4 MB max). Written entries must be submitted by completing the text box. Internet entries must be submitted by 11:59 PM ET on 11/19/07. All entries become the property of The J.M. Smucker Company (“Sponsor”) and none will be returned. Videos entries must not contain any identifiable person other than entrant, and neither video, audio nor written entries may include any intellectual property of third parties, including copyrighted material (including but not limited to music) or trademarks.

ELIGIBILITY: This Contest is open to legal residents of the 50 United States and the District of Columbia, eighteen years of age or older at time of entry. Employees of Sponsor, its affiliates, subsidiaries, distributors, sales representatives, retailers, advertising, promotion and judging agencies and all other service agencies involved with this Contest, and members of the immediate families (parent, child, sibling and spouse) or households of any of the above are not eligible.

JUDGING: Initial Judging: Entries will be judged by a qualified panel of judges based on creativity/originality (up to 50 points), relevance to theme (up to 25 points) and clarity of thought (up to 25 points). The entries accumulating the top 11 total points according to the criteria listed above will be determined on or about 11/29/07 and will be the 11 semi-finalists (subject to eligibility verification). Online Judging: The 11 semi-finalist entries will be posted on the Sponsor’s website, www.hungryjack.com for consumers to judge and vote for starting at 12:00 AM ET on 12/09/07. Follow the on-screen directions to vote for the best entry based on the criteria above. Internet votes must be submitted by 11:59 PM ET on 12/15/07. Limit one vote per person/e-mail address per day. Automated methods of voting are prohibited. By voting in the Online Judging you may also enter the Online Drawing (see instructions below in Online Drawing). Final Judging: The top four scoring entries from the combined Initial and Online Judging points will then advance to final judging but no previous points will be carried forward. The top four entries will be judged by a qualified panel of judges who will select the Grand Prize winner based upon the criteria set forth above on or about 12/17/07. The decisions of the judges will be final and binding on all matters relating to this Contest. In the event of a tie by the judges, the entries involved in the tie will be re-judged by an additional judge who will serve as a tiebreaker and who will evaluate entries according to the criteria listed above.

PRIZES: One Grand Prize: Gas and groceries for one year in the form of $15,000.00 worth of gift cards from the retailer(s) of winner’s choice. Approximate retail value (“ARV”): $15,000.00. 10 Runner Ups Prizes: $500.00 worth of gift cards from the retailer of winner’s choice. ARV: $500.00, each. Total ARV of all Contest prizes: $20,000.00. Prizes are not transferable. No cash redemptions, other than as set forth herein. No prize substitutions permitted, except by Sponsor, who may substitute a prize of equal or greater value if advertised prize becomes unavailable. All prizes will be awarded provided they are properly claimed in accordance with these Official Rules and a sufficient number of eligible entries are received and provided further that circumstances permit.

ONLINE DRAWINGS: by participating in the Online Judging at Sponsor’s website, www.hungryjack.com starting at 12:00 AM ET on 12/09/07 you may also enter the Online Drawings (“Drawing”) by following the on-screen directions to enter, provided you meet the eligibility criteria stated above. Internet entries must be submitted by 11:59PM EDT on 12/15/07. Limit one entry per person/email address per day. DRAWING PRIZES: Two First Prizes: a KitchenAid® Cookware Set. ARV: $150.00, each. Five Second Prizes: a Rival® Gourmet Crock-Pot® and NordicWare® Blini Pan. ARV: $100.00, each set. 70 Third Prizes: a Weber®'; Smokey Joe® Grill. ARV: $35.00, each. Total ARV of all Drawing Prizes: $3,250.00. The winners will be selected in random drawings from among all eligible entries received. The order in which Drawing Prizes are awarded is at the sole discretion of the Sponsor. The Drawings will be conducted by an independent judging agency on or about 12/17/07. Odds of winning a prize depend on the total number of eligible entries received.

GENERAL TERMS & CONDITIONS: Limit one prize per household. All potential Semi-Finalists, Grand Prize and Online Drawing winners (collectively “Winners”) will be notified by mail. If Semi-Finalist status or a prize is won by an eligible minor, it will be awarded in the minor’s behalf to a parent or legal guardian, who must sign any required documents. Potential Contest Winners (or parent/legal guardian if potential winner is an eligible minor) must execute and return an affidavit of eligibility and liability/publicity release (where permissible) within 7 days of receipt of notification or Semi-Finalist status and prize will be forfeited and an alternate selected on the basis of the criteria stated above and if circumstances permit. Prizes will be shipped within 6-8 weeks. If Semi-Finalist status notification or any prize is returned as undeliverable, status and prize will be forfeited. By entering this Contest and/or Drawing, all entrants agree that neither Sponsor, its affiliated or subsidiary companies, nor their respective directors, officers, employees or agencies will have any liability whatsoever for any injuries, losses or damages of any kind caused by or in connection with any prize or resulting from participation in this Contest and/or Drawing, or from acceptance, possession or use of any prize or participation in any prize-related activity or use by Sponsor of the entry in any manner. Winners further acknowledge that the above parties are in no manner responsible or liable for, and specifically disclaim any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize or portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Submission of a Contest and/or Drawing entry will constitute and signify the entrant’s agreement and consent (or that of parent or legal guardian if entrant is an eligible minor) that the Sponsor and/or the Sponsor’s assignees may use the entry, name, photograph, likeness and/or prize information for promotional purposes in commerce and in all media worldwide now known or hereinafter developed without time limitation and without further compensation, except where prohibited. Submission of a Contest entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify the entry in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without time limitation and without further consideration to the entrant. Submission of any entry further constitutes the entrant’s (or his/her parent’s or guardian’s) consent to irrevocably assign and transfer to the Sponsor any and all rights, title and interest in and to the entry, including, without limitation, all intellectual property rights. If, for any reason, this Contest or Drawing is not capable of running as planned by any cause which, in the sole opinion of the Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest or Drawing, Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend this Contest and determine winners from entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. Winners are solely responsible for any local, state, or federal taxes on prizes. Void where prohibited. All federal, state and local laws and regulations apply. Entrants must be the sole creators of the entries submitted in this Contest. Entries may not have won previous awards, may not have been published previously and must not infringe upon any other person’s rights. If due to any technical, production or other error, more prizes are claimed or awarded than are described in these Official Rules at any prize level, the number of prizes identified in these Official Rules will be awarded in a random drawing from all such prize claims received. By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with this Contest, will be governed by, and construed in accordance with, the laws of State of Ohio, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including without limitation barring entrants who do not comply with these Official Rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Cleveland, Ohio.

LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e mail address submitted at the time of entry. “Authorized account holder” is deemed as the natural person who is assigned to an e mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e mail addresses for the domain associated with the submitted e mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, mutilated, incomplete, postage-due or non-delivered entries; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of this Contest or Website, may be acting in violation of the terms of the Website or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of this Contest is unlawful and subject to legal action by Sponsor or its agents.

IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS ACCESS TO AND USE OF THE CONTEST INTERNET SITE OR DOWNLOADING FROM AND OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE.
